The purchase of products offered on verreriebiot.com website is subject to the present Terms and Conditions (“Terms and Conditions of Sale”).

The verreriebiot.com website is operated by the company BIOT, manufacturer and entitled with the rights to sell the products offered at the verreriebiot.com website. The products bought from the verreriebiot.com website shall be dispatched directly from BIOT logistic sites in France to the final consumers.

Orders may only be placed on the verreriebiot.com website by individual consumers and corporations purchasing BIOT products other than for resale. Any resale or distribution of BIOT products purchased on verreriebiot.com website is strictly prohibited.

BIOT may update the Terms and Conditions of Sale at anytime. You can view the most current version (at the date of use of the verreriebiot.com website) of the effective General Conditions of Sale at any time by clicking on the hyperlink labelled «Terms and Conditions of Sale “.

For each order on verreriebiot.com website, your acceptance of the Terms and Conditions of Sale in force at the date of the order will be requested.

Terms of Ordering

The verreriebiot.com website is hosted in France and allows final consumers to order on-line a selection of BIOT products from La Verrerie de Biot via the Internet, from all countries in the world.

The delivery zone for BIOT products ordered via the verreriebiot.com website is restricted to the following countries: [PLEASE LIST DELIVERY COUNTRIES]. (See “Delivery zone”).

For each BIOT product selected on the verreriebiot.com website, a summary page will be displayed automatically featuring a photograph of the item, its coloring and references, the quantity selected, its unit price and the total amount owed for your order. You should check that this information accurately reflects your selection before confirming your order.

Upon confirmation, your order will be submitted to BIOT for processing (see “Acceptance of orders”). While every effort is taken to try to ensure that the coloring, design and style of the BIOT products in the photographs displayed on the saint-louis.com website are representative of the original products, variations may occur due to technical restrictions of color reproduction on your computer equipment. Accordingly, BIOT shall be under no circumstances liable for any error or inaccuracy in the photographs or graphical representations of BIOT products displayed on the saint-louis.com website. BIOT reserves the right to cancel any order placed by a customer with whom it has a dispute concerning a prior order, or if BIOT has reasonable elements to suspect that such customer has violated these General Terms and Conditions of Sale, or is engaged in any fraudulent activity or for any other legitimate cause.


  1. Availability

Our offers of products BIOT ² and their prices are valid as they are on view on the verreriebiot.com website, subject to availability. In this purpose, instructions about the availability of the products will be given at the time of the ordering.

Exceptionally, errors or amendments could happen, especially in case of simultaneous orders of the same product by several customers. In case of unavailability of a BIOT product after ordering, you will be informed of that by email or by phone as soon as possible, and it will be proposed to you either to order another item offered on the verreriebiot.com website in replacement or to cancel your order. If you choose to cancel your order, you will be immediately refunded, if your bank account has been debited, on the bank account that has been debited.

BIOT shall not liable in case of stock outage or unavailability of products.

BIOT reserves the right to change at any time and without any previous notice the BIOT products proposed on the verreriebiot.com website.


  1. Order Confirmation

A. At the end of the ordering procedure, you are invited to click on the “Pay” icon.

B. As from confirmation, your order is transmitted to BIOT for processing. The order could not be amended or cancelled except in the express conditions provided for in the Terms and Conditions of Sale. The confirmation of your order means your acceptance of the wholeness of the Terms and Conditions of Sale.

C. You will receive an order summary.
The data registered by the verreriebiot.com website establish the proof of the whole transactions operated between BIOT and its customers. In case of dispute between BIOT and one of its customers about a transaction made on the verreriebiot.com website, the data registered by BIOT are considered as an irrefutable proof of the content transaction.
In pursuance of the article L.134-2 of the French Consumer Code, when an order deals with an equal or superior to 120 euros amount, BIOT shall keep the written document which states the contract concluded between BIOT and a customer by electronic way from the execution of the contract, and within 10 years from the delivery date of the product(s) (in accordance with the executive order 2005-137 of the 16th February 2005). You can have access to this document at anytime subject to a request sent to Customer service at verrerie@verreriebiot.com and the justification of your identity.


  1. Price – Payment

The prices of BIOT products are in euros, inclusive of taxes (European Union area). BIOT reserves the rights to amend at any time and without any previous notice the prices of the proposed BIOT products on the verreriebiot.com website.

Invoicing of the BIOT products is based on a price list posted on the verreriebiot.com website at the time of the confirmation of your order, subject to the availability of the BIOT products ordered at this time.

Any order at the verreriebiot.com website has to be settled immediately after the confirmation of the order.

We only accept the credit card and charge card payment.

Orders are payable in euros. Accepted credit cards are: MasterCard®, Visa®, American Express®. Your order shipping will be effective after the checking of your payment mode and the acknowledgment receipt of the debit of your bank account.

The debit of your charge or credit card is effective immediately.


  1. Title Retention

The ordered BIOT products remain the property of BIOT until full payment of the price to BIOT². In case of a payment incident, you undertake to return the received BIOT products to BIOT upon first request.

However, you shall bear the risks (in particular of loss, stealing or damage) relating to the delivered BIOT products and this at the effective date of the delivery.


  1. Delivery zone

BIOT products purchased via the verreriebiot.com website may be ship worldwide.

During the ordering procedure and for safety reasons, BIOT will not process any order for which a post office box or “Cedex” address is provided.

Saint-Louis products will be shipped to the delivery address specified during the ordering procedure.


  1. Duty and Shipping costs

We will inform you of shipping costs for the shipment considering the country of delivery. This amount will be payable by you in addition to the price of the goods ordered.

An order summary will be displayed on the verreriebiot.com website before you confirm your order.

The duty and taxes at the arrival destination outside Europe are not include.


  1. Time required for delivery

Allow 7 (seven) working days between the date of your order and the date of delivery.

However, BIOT reserves the right to divide your order into part shipments.


  1. Problems in delivery

Any failure to deliver or late delivery exceeding eight (8) business days shall be reported to our Customer Services Department as soon as possible. In order for your claim to be accepted, please notify us of it within a maximum of thirty (30) calendar days from the date of confirmation of your order.

Also, any complaint regarding the conformity or quantity of the BIOT products delivered shall be brought to the attention of our Customer Services Department as soon as possible. In order for your claim to be accepted, please notify us of it within a maximum of thirty (30) calendar days from the date of confirmation of your order.

You should check that your shipment is correct on delivery. If there are any discrepancies in your order when the products are delivered to you, you should note the nature of the potential discrepancy (e.g., open package, damaged goods, etc.) and email to Customer service at verrerie@verreriebiot.com

If the goods do not conform to your order or you are not satisfied with them, you may return them, exchange them or request a refund according to the terms and conditions contained in the section entitled “Returns – Exchanges – Refunds”


  1. Returns, exchanges, refund

You are entitled to return or ask for the refund of any product ordered via the verreriebiot.com website within the fifteen (15) calendar days following the date of delivery, subject to the following terms and conditions:

You must fulfil the “Return form” and indicate if you wish to exchange the returned BIOT products or be refunded of their amount.

If you exchange BIOT products, the shipping costs for the second delivery will invoiced to you.

Only one exchange by item will be honored. You may change the BIOT product bought through the verreriebiot.com website for one or several different items which together are equal or inferior in value to the full value of the original BIOT product you have received.

If you ask for a refund, BIOT shall do its best commercial efforts in order to ensure that the refund will be made within fifteen (15) business days following the receipt of the BIOT products returned by crediting your charge or credit card.

We do not refund any amount corresponding to a BIOT products that you have received as a gift (please note that you are only entitled to a merchandise exchange in this case).

In either case (exchange or refund), the shipping costs incurred by you to return products will only be refunded in case of non-conformity of BIOT products (e.g., product reference error, damaged, etc.). BIOT has sole discretion in determining whether the products are in original condition when returned to verreriebiot.com.

BIOT shall not be responsible or liable if any BIOT products you wish to return to the verreriebiot.com website is lost, misdirected or delivered late Insofar as you have to bear the risks of the shipping you have chosen.

For gifts purchased through the verreriebiot.com website, only exchange will be allowed (to the exclusion of any refund).

Any BIOT product purchased (or received as a gift) from the verreriebiot.com website may also be exchanged for a different BIOT product in the BIOT boutique located at Chemin des Combes, 06410 Biot, France within thirty (30) calendar days following the date of delivery, subject to the following terms and conditions:
– returned BIOT products must be in their original condition and packaging;
– you must provide the original receipt along with your returns, or a copy of the receipt if you are returning part of your order.

The shipping costs of the first delivery of a product purchased on the verreriebiot.com website will not be refunded when you return for exchange the product to the BIOT boutique referred to above.

The BIOT boutique does not offer refunds on any BIOT products purchased on the verreriebiot.com website. Under no circumstances will it be possible to credit your charge or credit card.

In order to request for the refund of a BIOT product purchased on verreriebiot.com website by exercising your retraction rights, you have to follow the previous procedure entitled “to verreriebiot.com”.


  1. Hidden Defect Warranty

BIOT warrants the conformity defect of the BIOT products offered for sale on the verreriebiot.com website according to the terms of the articles L211-4 and following of the French Consumer Code and 1641 to 1649 of the French Civil Code.

Limitation of Liability

BIOT shall not be liable for any indirect, incidental special or consequential damages, including, without limitation, loss of profits or other intangible losses, arising out of or in connection with your use, buying of BIOT products, or inability to use the verreriebiot.com website.


  1. Law – Disputes

These General Terms and Conditions of Sale shall be governed by and construed in accordance with the French law, without regard to principles of conflicts of laws. In the event of a dispute, the Court of Antibes, France, shall have exclusive jurisdiction and you hereby agree to submit to the exclusive jurisdiction of such court.

BIOT shall be entitled to seek and obtain injunctive or other equitable relief to protect its rights hereunder.
